Following implementation of the tenancy reforms in Renters’ Rights Act (2025) on 1^st May, the National Codes has become aware that some Members are considering ways to move tenants from existing tenancy arrangements onto common law agreements. This note is being issued to Members to explore some of the issues and risks involved in these practices, and all Members are requested to take note of its contents.
